Terms and conditions

Article 1: Purpose and definitions

By instructing and ordering services from SIMPLY LONDON (by booking our services online), you acknowledge that you have read, understood and accepted, without reserve, these Terms and Conditions.

The terms “customer”, “you” and “your” mean the customer.

The terms “we”, “SIMPLY LONDON” and “our” mean SIMPLY LONDON.

Article 2: SIMPLY LONDON relocation services

Unless otherwise agreed in writing at the time of the quotation, the quotation (details of services and price) shall remain valid for three months from its date of issue.

SIMPLY LONDON undertakes to use all reasonable means in its property searches, but cannot guarantee that the property chosen by the customer will be available at the required time and/or price.

Once customer specifications have been established, SIMPLY LONDON will need to issue a new price quotation if any changes are made to property search criteria, when the search is already underway.

SIMPLY LONDON can check a tenancy agreement’s content on the client’s behalf, but final acceptance of the tenancy agreement’s conditions shall remain the responsibility of the customer.

Since we do not provide qualified legal or accountancy services and our services do not constitute a legal or financial adviser/customer relationship, we recommend that you consult a qualified professional on all questions regarding legal or financial matters relating to documents received during the performance of our services.

Article 3.1: Price and payment

All prices quoted in the Online Booking Form include VAT and other applicable taxes.

Unless otherwise agreed, invoices shall be payable in full prior to commencement of our services.

Services may not commence before receipt of payment.

Article 3.2: Cancellation

You have 14 days to cancel your order. Cancellation can be done by using this cancellation form, which should be sent to [email protected]

Should an order be cancelled after work has commenced, any work already carried out shall be charged in full (100%), plus any fees and expenses incurred by SIMPLY LONDON in relation to the work or as a result of the cancellation.

Should an order be cancelled before work has commenced, we will refund the full amount, minus an administration charge of £150.

Article 4: Complaints

Complaints regarding the delivery or quality of services requested by the client may only be considered if submitted by registered letter with recorded delivery no later than 15 working days after the completion of the relevant services.

Liability on the part of SIMPLY LONDON shall be limited to a maximum of the amount of the relevant part of the invoice.

Should we reject your complaint, you may make take your complaint to the Property Redress Scheme, of which we are members.

Article 5: Limitation of liability

SIMPLY LONDON cannot at any time be held responsible for direct or consequential damages in relation to agreements between the customer and third parties, even where SIMPLY LONDON has acted as agent or intermediary in such agreements. SIMPLY LONDON cannot be held liable for loss or damage of any nature suffered by the customer as a result of a tenancy agreement, even where SIMPLY LONDON has provided advice on the agreement.

None of provisions of these general conditions shall be taken to exclude or limit the liability of SIMPLY LONDON in relation to loss or damage involving death or bodily injury arising from negligence on the part of SIMPLY LONDON.

SIMPLY LONDON may not be held responsible should the customer reject all of the properties selected by SIMPLY LONDON, where such selection is based on specifications agreed in advance with the customer.

All property-related information is provided to SIMPLY LONDON by estate agents. SIMPLY LONDON cannot be held responsible for any inaccurate or incomplete information about the properties.

SIMPLY LONDON cannot be held responsible if, after an agreement between the property owner and the customer has been reached on the tenancy conditions, a property is not let to the customer, should the customer delay or refuse payment of the holding deposit for that property.

SIMPLY LONDON cannot be held responsible should a customer’s application for a property be refused by its owner on any grounds whatsoever.

Article 6: Force majeure

SIMPLY LONDON cannot be held responsible for breach of any contractual obligation in the event of force majeure events or accidents, including but not limited to disasters, fires, internal or external strikes, internal or external failures or breakdowns, or in general any event preventing the proper transmission and/or performance of orders (this includes but is not limited to incomplete/delayed information provided by the customer.).

Article 7: Severability

Should any provision of these terms and conditions be declared invalid, the remaining provisions shall remain in full force and effect.

Article 8: Confidentiality

SIMPLY LONDON undertakes to treat all documents and information provided by the customer as confidential and not to disclose any information to third parties, except where required for the performance of the service.

SIMPLY LONDON processes personal data in accordance with the Data Protection Act of 1998. For information on your personal data rights, please consult our privacy and personal data charter on the www.simplylondonrelocation.comsite.

Article : 9 Anti-money laundering

As a service provider, we are obliged to identify our customers in order to comply with anti-money laundering regulations.

These obligations include establishing the identity and domicile of our customers.

We also reserve the right to request confirmation of the source of funds passing through the account held by SIMPLY LONDON to/from a customer or third party account and to report transactions to the Serious Organised Crime Agency (SOCA), without prior notice, should SIMPLY LONDON have any doubt regarding the source of funds.

Article 10: Applicable law and disputes

By express agreement between the parties, this agreement is governed by and subject to English law.

This agreement is written in the English language. Should it be translated into one or more languages, the English version shall prevail in the event of inconsistencies or disputes.

The Courts of London shall have exclusive competence to hear all disputes, including cross claims and joinders, regarding the performance of the services provided or the enforcement of any provision of these terms and conditions. 

GDPR Consent Statement

1.1 I hereby grant Simplement Londres Ltd and third-party processors authority to process my personal data, and, if relevant, my family member’s data, for the purpose of providing relocation services, the scope of which has been confirmed at the time of the services purchase.

1.2 I am aware that I may withdraw my consent at any time by using form SL-GDPR-307 – Data Subject Consent Withdrawal Form – which can downloaded here.

1.3 I have read and understood the Privacy Notice SL-GDPR-301, which is included below.

1. Scope

All data subjects whose personal data is collected, in line with the requirements of the GDPR.

2. Responsibilities

The Data Protection Officer Sylvie Froger is responsible for ensuring that this notice is made available to data subjects prior to Simplement Londres Ltd collecting/processing their personal data. All Employees of Simplement Londres Ltd who interact with data subjects are responsible for ensuring that this notice is drawn to the data subject’s attention and their consent to the processing of their data is secured.

We are a Destination Service Provider, providing relocation services to expatriates to support their move to the UK. These services can include, but are not limited to, home search, school search, and settling-in services. The personal data we collect will be used for only the following purposes:  To provide the information to third parties involved in the services, such as, but not limited to, the home search, school search, and settling-in packages.  To comply with legal requirements in the UK, such as the Right to Rent regulation  To provide information to the future landlord, schools and local authorities Our legal basis for processing the personal data is:  Lawful basis The special categories of personal data concerned are:  Children under 16 (for the purpose of school registrations and landlord information)  Religion (where necessary only, for the purpose of religious school selection and/or registrations)

3.2 Consent

By consenting to this privacy notice you are giving us permission to process your personal data specifically for the purposes identified. Consent is required for Simplement Londres Ltd to process your personal data, but it must be explicitly given. Where we are asking you for sensitive personal data we will always tell you why and how the information will be used. You may withdraw consent at any time by using the “Data Subject Consent Withdrawal Form ” and / or “Parent Consent Withdrawal Form” and sending it by email to the Data Protection Officer of Simplement Londres Ltd. These forms are available by contacting the Data Protection Officer, and in the Consent Forms you will receive for signature.

3.3 Disclosure

Simply London is a trading name of Simplement Londres Ltd Registered in England, Company number 8830868. Simplement Londres Ltd will pass on your personal data to third parties, where necessary, in order to complete the requested relocation services. The following third parties might receive your personal data for the following purpose(s) as part of the processing activities, depending on the scope of services:  Estate Agents  Schools  Local authorities (Council)  Referencing agencies  Private landlords  Governmental organisations  Parish  Property Management company  Service Providers such as internet provider, insurer, utilities providers  Relocation Management software provider Data will not be passed on to third parties unless absolutely necessary for the completion of the services agreed with the client.

3.4 Retention period

Simplement Londres Ltd will process personal data for the duration of the requested relocation services, and will store the personal data electronically for 3 months (online) after completion of all requested services, and 2 years (offline) following the end of the 3 months period. You can refer to document SL-GDPR-209 Retention of Records Procedure, which the Data Protection Officer can provide on request.

3.5 Your rights as a data subject

At any point while we are in possession of or processing your personal data, you, the data subject, have the following rights:  Right of access – you have the right to request a copy of the information that we hold about you.  Right of rectification – you have a right to correct data that we hold about you that is inaccurate or incomplete.  Right to be forgotten – in certain circumstances you can ask for the data we hold about you to be erased from our records.  Right to restriction of processing – where certain conditions apply to have a right to restrict the processing.  Right of portability – you have the right to have the data we hold about you transferred to another organisation.  Right to object – you have the right to object to certain types of processing such as direct marketing.  Right to object to automated processing, including profiling – you also have the right to be subject to the legal effects of automated processing or profiling.  Right to judicial review: in the event that Simplement Londres Ltd refuses your request under rights of access, we will provide you with a reason as to why. You have the right to complain as outlined in clause 3.6 below. All of the above requests will be forwarded on, should there be a third party involved (as stated in 3.3 above) in the processing of your personal data. 3.6 Complaints

In the event that you wish to make a complaint about how your personal data is being processed by Simplement Londres Ltd (or third parties as described in 3.3 above), or how your complaint has been handled, you have the right to lodge a complaint directly with the supervisory authority and Simplement Londres Ltd‘s Data Protection Officer.
